That is the issue on which the Court is called upon to rule in the present request for a preliminary ruling. This request for a preliminary ruling from the Finanzgericht Baden-Württemberg (Finance Court, Baden-Württemberg, Germany) turns on the proper construction of the term ‘debtor’ as defined in the first and second indents of Article 202(3) of Regulation (EEC) No 2913/92, and more precisely on the parameters for holding a legal person liable for the conduct of its employees. In the same vein, the referring court also seeks guidance as to whether ‘obvious negligence’ within the meaning of Article 212a of the Customs Code includes the possible negligence of an employee...

According to the French tax authority, those taxes and penalties arise from the fact, first, that SCI Cairnbulg Nanteuil had not sought the ministerial approval provided for under French law in the case of transfers to a foreign company and, secondly, that, in any event, that approval would not have been granted to it since the company’s dissolution was not justified for commercial reasons, but had the objective of evading or avoiding tax.The referring court considers that in order to resolve the dispute before it, it is necessary to ascertain, in particular, whether Article 49 TFEU precludes national legislation which, for the purpose of preventing tax evasion and avoidance, systematically imposes a condition that the use of the common system of taxation applicable to mergers and operations treated as such is to be subject to a process of prior approval only for transfers made to foreign legal persons...

VA, Wereldhave International NV and Wereldhave NV (ECLI:EU:C:2016:808) was published.Once again, the Court of Justice has before it a case in which dividends distributed by a subsidiary (in this case, a Belgian company) to its (Netherlands) parent company are subject to a withholding tax levied at source by the tax authorities of the Kingdom of Belgium, in respect of tax on income from investments. The first of the questions on which the referring court seeks a preliminary ruling relates to the interpretation of Directive 90/435/EEC. In view of the particular status of the parent company in the Netherlands, it is necessary first of all to establish whether it should be treated as falling under ‘companies of a Member State’ to which the directive applies (Article 2).If that is the case, then the question arises whether the withholding at source is compatible with Article 5 of Directive 90/435, which in principle exempts the profits distributed by a subsidiary to its parent company from such a withholding tax.If, on the other hand, Directive 90/435 is not applicable in this case, then the referring court asks whether the Belgian legislation which renders the dividends in question subject to tax is consistent with Articles 49 and 63 TFEU...

  • Back Suffer - Customer Service Nightmare

I ordered the machine and it seemed to work relieving my back pain as advertised. However, it only worked for about 4 sessions then quit. I called Back-2-Life's "customer service" line and was told what has turned out to be a long series of lies. I was promised free return shipping and a replacement machine, I was then told they hadn't located the proof of purchase and would call me when they found it and arrange to pick up the defective machine. After a week, I called and was told that a supervisor would call back to discuss the lack of progress. After no call back, I called again and was told that a motor would be sent out (not the whole machine as I had been earlier promised) and I would receive it within a week. A week later and no motor, I am told that they have to check to see if they have the part and it will take 48 hours to find out if they have it. The bottom line is the machine does not function, and after 8 phone calls and 3 weeks I am still no closer to a remedy. The hassle with getting anything (including a straight answer) from Back-2-Life is NOT worth any benefit the machine may provide.

  • MissT - 10 Star Review

I bought this generator for an emergency power outage, thinking I would never use it. When I received it, I could only test that it worked. It did. It sat in my garage throughout the summer. We joked that we were prepared now, having this generator, so there wouldn't be any power outages. Well, when hurricane Sandy was predicted to hit our area I went out to buy gas to be ready.(My only mistake was, I only bought a 2 1/2 gallon gas can. I already had a 1 1/2 gallon can.)I was now prepared! When our power went out we immediately poured in the gas and started it up. No problem at all. We plugged in a full standing deep freezer and a refigerator/freezer. It was still going 13hrs later. We filled it up again, it went again. We thought we would only be out for 3 days the most, so this generator would at least save our food. Our house wasn't too cold and we use gas for cooking. Occasionally we plugged in a lamp or a coffee pot. After the 5th day it was too cold to stay in our house; we had to go elsewhere, but return everyday to take care of the generator. We had to stand on line for gas, and unfortunately we only had small gas cans. Every day we thought would be the last, but it was not. We would have dumped our food at the start if we knew we would be in this situation. Sometimes we couldn't get gas so we just let the generator stop when it ran out, and we kept the appliances closed. Then we started it up again. And so it went for 11 days. When it was over everything in the freezer and refrigerator/freezer was fine.
